Terms of Service

These Terms of Service (the "Terms") govern the use of marealab.ar and of the Marea Lab platform (the "Platform"). By subscribing to or using the service, you accept these Terms. If you do not agree, do not use the Platform.
1. The service
Marea Lab provides branding, content and automation services for small businesses:
- Content: generating carousels and videos aligned to the client's brand, and publishing them — manually or scheduled — on the social accounts the client connects.
- Messaging: an assistant that reads and replies, on the client's behalf, to the messages its customers send to the accounts the client connects (WhatsApp, Facebook Messenger, Instagram Direct, Telegram, or a chat widget on the client's website), plus a shared console where the client's team can take over any conversation.
Both always operate through each platform's official APIs.
2. Connected accounts and content
- The client connects its own social accounts voluntarily, through each platform's official authorization (OAuth) flow, and can disconnect them at any time from its dashboard.
- We only publish content the client created or approved. The client is responsible for the content of its posts.
- Marea Lab acquires no rights over the client's content beyond those needed to provide the service.
- We never ask for or store the passwords of connected accounts.
3. Conversations and responsibility for replies
- The assistant replies on behalf of the client, using the knowledge base the client itself writes and approves. The client is responsible for the accuracy of that knowledge base and for what is said in its name.
- The client is the data controller for the conversations its customers hold with it; Marea Lab acts as a processor. See the Privacy Policy.
- The assistant escalates to a person when it cannot resolve something, and any team member can take over a conversation at any time — the assistant then stops replying in that conversation.
- The service is reactive: the assistant answers people who write first. It is not used to send unsolicited messages.
4. Acceptable use
By using the Platform you agree not to publish or send illegal, misleading, offensive or infringing content (including copyright and trademark infringement), not to use the service for spam or bulk unsolicited messaging, and not to use it to circumvent the policies of the connected platforms.
5. Compliance with platform policies
Use of the Platform on each network is additionally subject to that network's policies, which the client agrees to respect:
- Meta (WhatsApp, Instagram and Facebook): the Community Standards, the Meta Platform Terms and the Developer Policies. Messaging is reactive and follows Meta's messaging windows and rules.
- TikTok: the TikTok Community Guidelines, the Developer Terms of Service and the Developer Guidelines. We publish only the client's own content, previously approved by the client.
- Google: the Google Business Profile policies.
6. Privacy
The processing of personal data is governed by our Privacy Policy, which forms part of these Terms.
7. Availability and liability
We work to keep the service continuously available, but we do not guarantee uninterrupted availability: publishing and message delivery also depend on third-party APIs. To the extent permitted by law, Marea Lab is not liable for indirect damages arising from interruptions or changes to those platforms, nor for the content published or sent by the client.
8. Billing and cancellation
Services are contracted on a monthly subscription, according to the proposal agreed with each client. The client may cancel by giving at least 10 days' notice before the end of the period. On cancellation, connected accounts are disconnected and the associated tokens are deleted.
9. Suspension
We may suspend or terminate access in the event of use that breaches these Terms or the policies of the connected platforms.
10. Changes
We may update these Terms; relevant changes are communicated to active clients and the current version is published on this page with its update date.
11. Governing law
These Terms are governed by the laws of the Argentine Republic, with jurisdiction in the courts of Puerto Madryn, Chubut.
